    no I canceled the claim because the cards finally came after being lost in the mail for 3 weeks

    If it was me I would look at it from both standpoints.

    If you had sold these cards and this happened to you how would you handle the situation. If you would have handled it differently I would send the feedback. If you would have been a little suspicious I would just let it go.

    Hey Tracy, have ya got a RH tail light lens for a chev avalanche..like a doofus I just broke mine.

    Negative. I have only had one Avalanche and it was squished like pancake.

    Well the thing is I know the rules when it comes to paypal. If you don't have tracking and there is no proof the item was shipped then the buyer wins. I always have a tracking number when selling and honestly as much as it would suck I'd just refund the money if I had no tracking and no way to prove the seller didn't get their item. I've had sellers do it for me and I appreciate that so I'd do the same to another buyer.

    I completely agree with that.

    I'd say it's a bit much, Jen. No need to argue back and forth. You received your item and he has negative feedback.

    In my mind, when one individual sends a package to another, it is not the seller's responsibility to guarantee the item's receipt. He has done his part by packaging and mailing it. If it gets lost in the mail, it is not the sellers fault. Likewise, it is not the seller's fault if the package is left at the residence of the recipient and stolen. Some places with great customer service that can take the hit for the product will send out a new one, but it is unreasonable to expect that an individual reship something. In the perfect world, I would say that if an item gets lost in transit, that you wait for it for a couple weeks to see if it shows up. If it doesn't show up, both the seller and the buyer should take the hit for the lost item.

    meh I'm going to leave it alone, the problem is so many sellers don't understand that when they use ebay and stuff gets lost in the mail or damaged it is considered their fault

    I would have to disagree with this. I don't think it is the sellers fault that it gets lost or damaged (unless packaged badly). However, I do feel the seller is obligated to make the matter right. In my business I will refund my customer and then take the fight to the shipping company, UPS,USPS,or Fedex. I do this because it certainly isn't my customers fault any more than it is my fault. Now, having said this, it is a lot easier to win the claim with UPS and fedex compared to USPS.

    I'm not saying if it should or shouldn't be considered their fault but when it comes to ebay if a buyer does not get what they paid for or the item is damaged the buyer gets a refund from paypal if they request one.

    Agreed.

    This is one of my peeves with the post office and ebay, mainly. This whole add $1 for insurance is a load of crap. With UPS and Fedex you are insured up to $100 and anything over you pay for as an extra. I find this $1 insurance thing b/s because it is a scapegoat for some sellers. I don't really blame the sellers because they are just taking advantage of a crappy policy.

    I wasn't aware that was a little known fact I thougth everyone knew that... shows what little I know...

    Well... just got back from Coraline 3D. Well those of you who reviewed were correct. Good movie, but the old ladies in pasties were really disturbing. I think I need eye-bleach. Daughter was all meh about the movie. I wonder how much it will lose when it is on a 2D screen or if they will go the cruddy red/green 3D glasses for DVD.

    I have had a few eBay auctions come damaged. Thankfully in each case, I did go ahead and get the insurance, but it was still a PITA to work out the issue. You have to prove that you received the items damaged, need pictures of the crushed container, etc... And even then you are assumed guilty until proven innocent of mail fraud.
