Seems pretty cut & dry. NEW phone is not new. End of story. Sorry to hear this and sorry for the hassle this whole ebay dispute & return process will initiate.
After joking about this package, I'm sorry that's what happened. I've had to open cases before, and it usually works out for the buyer. But still, that's really annoying and crappy.
Thanks, I've sent the seller a message outlining the issues and waiting to hear back from them. If I haven't heard anything in a couple of days I'll initiate a dispute. Only thing that sucks is that now I guess I'll be paying to have the item sent back to them - with insurance and tracking that's going to be about $20.
I would refuse to be responsible for the shipping because of the fact that they misrepresented the phone. I would just open a complaint and let ebay settle it. Why should you be out anything?
Never done a dispute before so not sure what options I have. Still have not heard anything from them. Will give them until end of Tuesday before I open the dispute. Oh well.
Well I wish you the best of luck with your whole situation. It's sad that there are such mendacious individuals out there that misrepresent products in order to make a few extra dollars.
